What is civil partnership?
Civil
Partnership is a new legal relationship, which can be formed by two people of
the same sex. It gives same sex couples the ability to obtain legal recognition
for their relationship. Couples who form a civil partnership will have a new
legal status – that of “civil partner”.
Same-sex
couples who form a civil partnership will have parity of treatment in a wide
range of legal matters with those opposite-sex couples who enter into a civil
marriage.
The rights and
responsibilities civil partners will have include:
- A duty to
provide reasonable maintenance for your civil partner and any children of the
family;
- Ability to
apply for parental responsibility for your civil partner’s child;
Equitable
treatment for the purposes of assessment for child support; life assurance;
tax, including inheritance tax; employment and pension benefits; inheritance
of a tenancy agreement;
Recognition
under intestacy rules;
Access to
fatal accidents compensation;
Protection
from domestic violence; and
Recognition
for immigration and nationality purposes.

Registering a civil partnership
To register for a civil partnership, the couple must be of the same sex and over
18 years of age, for those between 16 -17 proof of consent will be required.
Neither should be related to each other or in an existing marriage or civil
partnership
The couple must give 15 days notice to the
council registrar of their intention to form a civil partnership, The notice
will be displayed for 15 days and is valid for 12 months. Registration must take
place in any building certified for civil marriage such as a Register Office or
approved premise and carried out by the councils registrar.
Formation of a civil partnership
The formation takes place when the couple sign
the civil partnership schedule in the presence of two witnesses
Fees
Cost of forming a Civil Partnership

The statutory notice fee
£30 for each person.

A civil partnership
formation fee of £40
(with or
without a ceremony) in the Register Office is also
payable

Certificate £3.50
-
Fees for approved premises vary throughout the
country.
Documentation
You will be required to produce evidence of
who you are and proof of residence:
- Birth certificate or passport
- Bank statement or utility bill
If you were previously married or in a
previous civil partnership you need to produce:
- Proof of dissolution such as a divorce
decree absolute
If you were previously married or in a
previous civil partnership and your wife, husband or former civil partner has
died then you need to produce:
If you have changed your name through deed
poll you will be required to produce:
- A change of name document or statutory
declaration

There is no legal
requirement for either of the couple to change their surname upon
entering into a civil partnership.
